We strongly advise you to read, understand and agree to our Terms and Conditions before you use our apps or services. 4.1 WHAT PERSONAL INFORMATION DO WE COLLECT ABOUT YOU?
We provide real-world augmented reality and location-based puzzles, designed to enable you to interact in mixed worlds. Hence, for us to be able to provide a great virtual experience blended with real world, we need some information about you.
When you create an account with us or when you use our Services or when you interact with us, we collect and store the following personal information YOU PROVIDE TO us:
Account details: your name, email address(es), passwords, and other identification information.
Profile information: your location, your home location, your profile photo, your cover photo, any other photo uploads, your “about” me information, etc.
Information you provide to websites that link to or from our Services, including any social networking sites to which you choose to link your account.
Content and information, you provide through the Outwit Adventures website or by email to us.
Information you provide to us if you apply for a job, including information in your resume or application form.
Any information you provide as part of a survey or reviews.
4.2 PERSONAL INFORMATION WE COLLECT AUTOMATICALLY
When you use our Services, we automatically receive and record information from your browser or mobile device for purposes of providing you Services that are personalized, relevant, and useful to you:
Your precise geolocation, where you have enabled this on your mobile device or GPS device.
The unique identifier for your mobile device.
Install ID and details about our app such as version number and name.
Your IP address.
Time, date and location of access and use of the Services.
Your user ID for the account through which you are accessing our Services.
Your search data, including the latitude and longitude of any location-based search you perform either intentionally or via the automatic search of your current location performed when you open our apps.
In case you choose to link your account with us to your social media account (e.g., Google, Apple), we may collect general personal information about you through your social media account, such as email address, name, and profile photo.
4.3 WHAT SPECIAL ACCESS PERMISSIONS WE REQUIRE FROM YOU AND WHY?
Location Access: To bring you with virtual experiences mixed with real life, largely through our location-based puzzle hunt applications, our apps need access to your location data. This location data is accessed only while our app is in use and is used solely for the purpose of use in app.
Camera Access: To bring you the experience of Augmented Reality, our app needs access to your camera while it is in use. This access is only used while the app is in use.
4.4 HOW DO WE USE YOUR PERSONAL INFORMATION?
We use your personal information for the following purposes:
To provide our Services to you and to administer your account with us.
For our own internal business purposes, such as analyzing the use of our Services (via Services like Google Analytics, App Store Analytics, and others), market research, website and mobile application optimization and improve our products and Services.
To verify your identity.
To provide customer service and review issues with your account or your use of our Services.
4.5 WHAT RIGHTS DO I HAVE IN RELATION TO MY PERSONAL INFORMATION?
Your rights in relation to how we use your information
You can choose how we use your personal information in the following circumstances:
You can add, update, or delete certain personal information by signing into your account and accessing your Account Settings.
If you have granted us access to your Google, or Apple sign on, you can disconnect the link by logging into account settings, accessing your profile and clicking to remove access.
If you choose not to provide these personal information or access permissions, we may not be able to provide you with our Services, or certain aspects of our Services.
Other rights in relation to your personal information if you are accessing the Services in Europe:
In addition to the choices described above you also have the following rights under the European General Data Protection Regulation (“GDPR”) if you are accessing the Services in Europe:
Right of access to your Personal Data (Art. 15 GDPR): You have the right to ask us for confirmation on whether we are processing your Personal Data, and access to the Personal Data and related information on that processing (e.g., the purposes of the processing, or the categories of Personal Data involved). “Personal Data” is defined in the GDPR as any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person;
Right to rectification (Art. 16 GDPR): You have the right to have your Personal Data corrected, as permitted by law.
Right to erasure (Art. 17 GDPR): You have the right to ask us to delete your Personal Data, as permitted by law. This right may be exercised among other things: (i) when your Personal Data is no longer necessary for the purposes for which it was collected or otherwise processed; (ii) when you withdraw consent on which processing is based on your consent and where there is no other legal ground for processing; (iii) when you object to processing which is necessary for our legitimate interests (pursuant to Art. 21 (1) GDPR) and there are no overriding legitimate grounds for the processing, or when you object to your Personal Data being used for direct marketing purposes (pursuant to Art. 21 (2) GDPR); or, (iv) when your Personal Data has been unlawfully processed.
Right to restriction of processing (Art. 18 GDPR): You have the right to request the limiting of our processing under limited circumstances, including: when the accuracy of your Personal Data is contested; when the processing is unlawful and you oppose the erasure of your Personal Data and request the restriction of the use of your Personal Data instead; (and, when you have objected to processing which is necessary for our legitimate interests (pursuant to Art. 21 (1)) GDPR pending the verification whether the legitimate grounds of Outwit Adventures Inc. override your grounds.
Right to data portability (Art. 20 GDPR): You have the right to receive the Personal Data that you have provided to us, in a structured, commonly used and machine-readable format, and you have the right to transmit that information to another controller, including to have it transmitted directly, where technically feasible.
Right to object (Art. 21 GDPR): You have the right to object to our processing of your Personal Data, as permitted by law. This right is limited to processing which is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller or processing which is necessary for the purposes of our legitimate interests (Art. 6 (1) (e) or (f) GDPR), and includes profiling based on those provisions, and processing for direct marketing purposes.
4.6 HOW LONG DO WE KEEP YOUR PERSONAL INFORMATION?
· Account deletion: If you want to permanently delete your account or following your explicit request for deletion of any of your personal information, we will delete your account and/or help you to delete your personal information as requested. It may take up to 30 days for the records to be deleted or overwritten. In some circumstances (explained below) we may keep your personal information for longer.
· When you stop playing: If you stop playing or temporarily disable your account, without taking any further steps or asking us to permanently delete your account or personal information, we will keep your information until it get’s overwritten/deleted by our system.
· Information provided for a specific purpose: If you have provided us with personal information for a specific purpose, we will keep your personal information for as long as we need to fulfill that purpose.
Where we have obtained personal information automatically about your use of our apps or website (e.g. analytics), we will keep this information for as long as we feel it may be useful to us to improve and develop our business. We will delete it when it is no longer useful.
4.7 HOW DO WE PROTECT YOUR PERSONAL INFORMATION?
We have appropriate security measures in place to prevent your Personal Data from being accidentally lost, used, or accessed in an unauthorized way, improperly altered, or disclosed. We also limit access to your Personal Data to employees, agents, contractors and other third parties who have a business need to know. They will only process your Personal Data on our instructions, and they are subject to a duty of confidentiality. We have put in place procedures to deal with any suspected Personal Data breach and will notify you and any applicable regulator of a breach where we are legally required to do so. However, keep in mind that no security measures are perfect or impenetrable.
4.8 DO I HAVE TO BE A CERTAIN AGE TO USE THE SERVICES?
As mentioned earlier, we provide location-based and web-based puzzles where augmented reality is the star technology of our Services. Hence, this leads to the access of the user’s location, camera, and other personal information as stated in the earlier sections and may require Google sign-in or Apple sign-in and a cellular data plan. Having said that, we strictly comply with the laws created to protect the privacy of children under 13 such as COPPA and hence our app requires you to be of age 13 and above.
However, individuals under 13 years of age are welcome to play Outwit Adventures games, either after following the consent of their parents or legal guardians who agrees to be bound by this Agreement or by having a parent or a legal guardian sign them in after providing their consent for an individual under 13 to play the Outwit Adventures games. Parents or legal guardians may also choose to create and manage an account for an individual who is under 13 years of age.
If you are a parent or guardian and discover that your child under the age of 13 has an account not created and managed by you, then you may alert us via email or contact us by one of the means provided in the Contact Us section and request that we delete that child’s personal information.
